RESOLUTION NO. 2016-06

 

A RESOLUTION AUTHORIZING THE VILLAGE ADMINISTRATOR TO ENTER INTO AN AGREEMENT WITH FOUTS BROS. INC. TO PURCHASE A TANKER TRUCK FOR THE VILLAGE FIRE DEPARTMENT; AND DECLARING THE SAME AN EMERGENCY

 

WHEREAS, the Council of the Village of Antwerp passed Ordinance No. 2016-23 authorizing the advertisement to solicit bids for the Village to purchase a tanker truck to aid in the provision of fire protection services pursuant to Ohio Revised Code § 737.24, said Ordinance passed by an emergency measure on June 10, 2016; and

 

WHEREAS, the Village advertised for bids to be submitted for the tanker truck to be purchased by the Village and the Village Administrator recommends that the Village award the contract to the lowest and best bidder; and

 

WHEREAS, Fouts Bros. Inc. submitted the lowest and most responsive bid in the amount of $202,197.00 to the Village of Antwerp for the tanker truck and the Village Administrator is the proper person to enter into a contract for the purchase of a tanker truck for the Village Fire Department.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Antwerp, Paulding County, Ohio:

 

Section 1.  The Village Administrator is authorized to enter into a purchase agreement with Fouts Bros. Inc. for the purchase of the tanker truck, a copy of such agreement is attached hereto.

 

Section 2.  The funds to purchase this tanker truck will be obtained in part from a grant and in part from a loan through the Antwerp Exchange Bank, which loan will be repaid through funds collected from Carryall Township’s levy for such purpose.  Any funds needed in excess of the loan amount for this purchase shall be paid from the fire fund.

 

Section 3.  It is found and determined that all formal actions of the Council of the Village of Antwerp, Ohio, concerning or relating to the passage of this Resolution were adopted in an open meeting of the Council, and that all deliberations of the Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements.

 

Section 4.  This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare of the Village and for the further reason that the Village is in immediate need of a new tanker truck for the well-being and safety of the residents and this Resolution shall be in full force and effect immediately after its passage; otherwise, it shall take effect and be in full force after the earliest period allowed by law.
