RESOLUTION NO. 2021-02
A RESOLUTION INITIATING AN AMENDMENT TO THE OFFICIAL ZONING MAP OF THE VILLAGE OF ANTWERP, OHIO, TO REZONE CERTAIN LOTS ADJACENT
TO ERIE STREET IN THE VILLAGE OF ANTWERP FROM R-2 MULTIPLE FAMILY DISTRICT AND B-1 DOWNTOWN BUSINESS DISTRICT TO B-2 GATEWAY COMMERCIAL DISTRICT, AND DECLARING THE SAME AN EMERGENCY
WHEREAS, the Council of the Village of Antwerp, pursuant to Section 703 of the Zoning Ordinance for the Village of Antwerp, hereby initiates an amendment to the Official Zoning Map of the Village of Antwerp in order to re-zone or change the classification of certain lots in the Village of Antwerp, said lots identified by lot number, parcel number, and/or street address on Exhibit A attached hereto, which lots are adjacent to Erie Street in the Village of Antwerp, from R-2 Multiple Family District and B-1 Downtown Business District classifications to B-2 Gateway Commercial District classification; and
WHEREAS, this proposed zoning map amendment is necessary and appropriate and consistent with the Village’s comprehensive plan as it allows for a consistent zoning classification in the area at issue for high quality mixed-use development in the area located near U.S. Route 24, and which is a corridor from the intersection of U.S. Route 24 and State Route 49 to the downtown business district in the Village of Antwerp; and
WHEREAS, the Council, upon adoption of this Resolution, hereby authorizes that the amendment proposed herein be transmitted to the Planning and Zoning Commission of the Village of Antwerp pursuant to Section 705 of the Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Antwerp, Paulding County, Ohio, as follows:
Section 1. The Council of the Village of Antwerp hereby initiates an amendment to the Official Zoning Map of the Village Antwerp to re-zone or change the classification of certain lots in the Village of Antwerp, said lots identified by lot number, parcel number, and/or street address on Exhibit A attached hereto, which lots are adjacent to Erie Street in the Village of Antwerp, and specifically to amend the Official Zoning Map so that said lots be re-zoned or the classification of these lots be changed from R-2 Multiple Family District and B-1 Downtown Business District classifications to B-2 Gateway Commercial District classification. A copy of the relevant portion of the Official Zoning Map for the Village of Antwerp is attached hereto as Exhibit B and highlighted to show the lots subject to the proposed amendment to be re-zoned or re-classified as B-2 Gateway Commercial District classification.
Section 2. The proposed amendment set forth herein to the Official Zoning Map shall be transmitted to the Planning and Zoning Commission for review and recommendations as provided in Section 705 of the Zoning Ordinance.
Section 3. It is found and determined that all formal actions of the council concerning and relating to the passage of this Resolution were adopted in an open meeting of this council, and that all deliberations of the council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal regulations including all lawful Ordinances, Resolutions, and any applicable provisions of Section 121.22 of the Ohio Revised Code.
Section 4. This Resolution is deemed an emergency measure necessary for the preservation of the public health, safety and welfare, and for the further reason to allow the initiation of an amendment to the Official Zoning Map for zoning classifications to comply with the use of the property within the Village and consistent with the Village’s comprehensive plan, and this Resolution shall be in full force and effect immediately after its passage; otherwise, it shall take effect and be enforced after the earliest period allowed by law.
