Resolution 2021-03: County Solid Waste Plan

RESOLUTION NO. 2021-03
A RESOLUTION APPROVING THE SOLID WASTE MANAGEMENT PLAN UPDATE FOR THE JOINT SOLID WASTE MANAGEMENT DISTRICT OF DEFIANCE, FULTON, PAULDING AND WILLIAMS COUNTIES, OHIO, AND DECLARING THE SAME AN EMERGENCY

WHEREAS, pursuant to the Ohio Revised Code Section 3734.55, the Joint District Policy Committee has updated and adopted a Solid Waste Management Plan for the Joint Solid Waste Management District of Defiance, Fulton, Paulding and Williams Counties, on February 11, 2021; and
WHEREAS, the Joint Solid Waste Management District of Defiance, Fulton, Paulding and Williams Counties request legislative action supporting the adoption of this plan; and
WHEREAS, the Council of the Village of Antwerp, County of Paulding, has received and reviewed the updated Solid Waste Management Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Antwerp, County of Paulding, State of Ohio:
Section 1. That the Council of the Village of Antwerp does hereby support and approve the adoption of the Joint Solid Waste Management District Plan Update.
Section 2. That the Fiscal Officer of the Village of Antwerp be, and hereby is, authorized and directed to send a certified copy of this Resolution to the Joint Solid Waste Management District of Defiance, Fulton, Paulding and Williams Counties, Ohio.
Section 3. It is found and determined that all formal actions of the Council concerning and relating to the passage of this Resolution were adopted in an open meeting of this Council, and that all deliberations of the Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal regulations including all lawful Ordinances, Resolutions, and any applicable provisions of Section 121.22 of the Ohio Revised Code.
Section 4. This Resolution is deemed an emergency measure necessary for the preservation of the public health, safety and welfare, and for the further reason to allow the approval of the Solid Waste Management Plan update for the Joint Solid Waste Management District within ninety (90) days of such update being adopted by the Joint District Policy Committee, and this Resolution shall be in full force and effect immediately after its passage; otherwise, it shall take effect and be in force after the earliest period allowed by law.
