A RESOLUTION INITIATING AMENDMENTS TO SECTION 307 OF THE
ZONING ORDINANCE OF THE VILLAGE OF ANTWERP, OHIO, ON B-2
GATEWAY COMMERCIAL DISTRICT AND TO SECTION 311 ENTITLED “PERMITTED, CONDITIONAL, ACCESSORY USE TABLE” FOR B-2 DISTRICT TO INCLUDE SINGLE FAMILY DWELLING UNITS AND TWO FAMILY DWELLING UNITS AS PERMITTED USES IN B-2 DISTRICT, AND DECLARING THE SAME AN EMERGENCY
WHEREAS, the Council of the Village of Antwerp, pursuant to Section 703 of the Zoning Ordinance for the Village of Antwerp, hereby initiates amendments to the Zoning Ordinance in order remove certain sections in Section 307 on B-2 Gateway Commercial District, change the language of Signage in B-2 District, and amend Section 311 on permitted, conditional and accessory uses in B-2 District, specifically to allow single family detached dwelling units and two family dwelling units as permitted uses in B-2 District with residential improvements based on R-2 zoning, as such proposed amendments are necessary and appropriate to clarify the zoning requirements applicable for properties designated as B-2 classifications in the Village of Antwerp consistent with the Village’s comprehensive plan; and
WHEREAS, Council recommends that Section 307 of the Zoning Ordinance be amended to remove the existing sections as follows: Section 307.04 on residential density, Section 307.04 on parking and loading, Section 307.06 on large building facades, Section 307.07 on windows, Section 307.08 on wall planes, Section 307.09 on roof lines, and Section 307.09 on exterior building materials, and for the sections located within Section 307 to be re-numbered once those sections are removed; to remove the language in Section 307.10 on signage and replace with the following language: “proposed signage needs to be submitted and approved before zoning application approval”; and to amend Section 311 entitled “permitted, conditional, accessory use table” to allow single family detached dwelling units and two family dwelling units as permitted uses in B-2 District with residential improvements based on R-2 zoning; and
WHEREAS, the Council, upon the adoption of this Resolution, hereby authorizes that the amendments proposed herein to be transmitted to the Planning and Zoning Commission of the Village of Antwerp pursuant to Section 705 of the Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Antwerp, Paulding County, Ohio, as follows:
Section 1. The Council of the Village of Antwerp hereby initiates amendments to the Zoning Ordinance, specifically that Section 307 of the Zoning Ordinance be amended to remove the existing sections as follows: Section 307.04 on residential density, Section 307.04 on parking and loading, Section 307.06 on large building facades, Section 307.07 on windows, Section 307.08 on wall planes, Section 307.09 on roof lines, and Section 307.09 on exterior building materials, and for the sections located within Section 307 to be re-numbered once those sections are removed; to remove the language in Section 307.10 on signage and replace with the following language: “proposed signage needs to be submitted and approved before zoning application approval”; and to amend Section 311 entitled “permitted, conditional, accessory use table” to allow single family detached dwelling units and two family dwelling units as permitted uses in B-2 District with residential improvements based on R-2 zoning. Attached as Exhibit A is a comparison of the existing Section 307 of the Zoning Ordinance and the proposed amendments showing the sections removed as proposed herein and the change in language for signage, as well as a highlighted version of Section 311 entitled Permitted, Conditional, Accessory Use Table adding as permitted uses single family detached dwelling units and two family dwelling units in B-2 District with residential improvements based on R-2 zoning.
Section 2. The proposed amendments set forth herein shall be transmitted to the Planning and Zoning Commission for review and recommendations as provided in Section 705 of the Zoning Ordinance.
Section 3. It is found and determined that all formal actions of the council concerning and relating to the passage of this Resolution were adopted in an open meeting of this council, and that all deliberations of the council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal regulations including all lawful Ordinances, Resolutions, and any applicable provisions of Section 121.22 of the Ohio Revised Code.
Section 4. This Resolution is deemed an emergency measure necessary for the preservation of the public health, safety and welfare, and for the further reason to allow the initiation of a zoning ordinance amendment to clarify the zoning requirements applicable to properties designated as B-2 classifications and consistent with the Village’s comprehensive plan, and this Resolution shall be in full force and effect immediately after its passage; otherwise, it shall take effect and be enforced after the earliest period allowed by law.
