Resolution 2022-04: Resolution of Support for Splash Pad Project

RESOLUTION NO. 2022-04

A RESOLUTION SUPPORTING THE HOLLY BEACH SPLASH PAD PROJECT BY ANTWERP COMMUNITY DEVELOPMENT COMMITTEE INC. AND GRANTING PERMISSION FOR THE CONSTRUCTION AND INSTALLATION OF A SPLASH PAD AT RIVERSIDE VETERANS MEMORIAL PARK; AND DECLARING THE SAME AN EMERGENCY

WHEREAS, the Antwerp Community Development Committee Inc. desires to install a splash pad in the Riverside Veterans Memorial Park located in the Village of Antwerp and this Committee, in conjunction with the Holly Kobee Foundation, is in the process of obtaining the necessary funds and/or pursuing the necessary funding mechanisms to construct and install a splash pad in the Park (said project known as the Holly Beach Splash Pad); and

WHEREAS, the Council of the Village of Antwerp supports the Holly Beach Splash Pad project as it creates and enhances recreational activities in the Riverside Veterans Memorial Park; and

WHEREAS, the Council of the Village of Antwerp grants permission to the Antwerp Community Development Committee Inc. to construct and install the splash pad in the Riverside Veterans Memorial Park once complete funding has been received in order to commence this project; and

WHEREAS, the Village of Antwerp and the Antwerp Community Development Committee Inc. shall enter into a Donation Agreement once such funding is obtained and prior to any construction of the splash pad in order to reflect the donation of the Holly Beach Splash Pad to the Village upon completion.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Antwerp, Paulding County Ohio:

Section 1. The Council of the Village of Antwerp hereby supports the Holly Beach Splash Pad project as referenced herein as a means to create and enhance recreational activity in the Riverside Veterans Memorial Park. A survey of the proposed location for the splash pad is attached hereto and incorporated herein by reference.

Section 2. The Council hereby grants permission to the Antwerp Community Development Committee Inc. to construct and install the splash pad in the Park (as reflected in the attached survey) once complete funding has been received and upon the approval of a Donation Agreement by and between the Village of Antwerp and the Antwerp Community Development Committee Inc.

Section 3. It is found and determined that all formal actions of the Council concerning and relating to the passage of this Resolution were adopted in an open meeting of this Council, and that all deliberations of the Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements.

Section 4. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare of the Village and for the further reason that the installation of a splash pad is beneficial to the well-being of the residents and in accordance with the recreational use of said park, and this Resolution shall be in full force and effect immediately after its passage; otherwise, it shall take effect and be in force after the earliest period allowed by law.
