THE REGULAR MEETING OF THE VILLAGE OF ANTWERP COUNCIL WAS CALLED TO ORDER AT 5:30 P.M. BY MAYOR JAN REEB. COUNCIL PERSONS PRESENT: KENNY REINHART, JASON FRANKS, STEVE JORDAN, DEAN RISTER, BRYAN SMITH, AND BRYCE STEINER.
ALSO IN ATTENDANCE: SOLICITOR MELANIE FARR, ADMINISTRATOR BRIAN DAVIS, FISCAL OFFICER AIMEE LICHTY, AND POLICE CHIEF GEORGE CLEMENS. VISITORS: ZONING INSPECTOR GABE OBERLIN, SHANNON RUSCHEL WITH WMEA, BILL BOYLAN, GAYLE RISTER, BARRY HOOK, KARLEEN GRIMES, AND DON OBERLIN.
MINUTES FROM THE REGULAR COUNCIL MEETING HELD MAY 16, 2022, WERE REVIEWED.
• MOTION MADE BY RISTER, SECONDED BY FRANKS, TO ACCEPT THE MINUTES FROM THE MAY 16, 2022, REGULAR COUNCIL MEETING. 5 YEAS, 1 NAY. MOTION CARRIED AND APPROVED.
THE MAY DISBURSEMENTS WERE REVIEWED AND DISCUSSED.
• MOTION MADE BY RISTER, SECONDED BY REINHART, TO ACCEPT THE MAY RECONCILIATION REPORT. 6 YEAS, 0 NAYS. MOTION CARRIED AND APPROVED.
VISITORS
SHANNON RUSCHEL FROM WMEA ADDRESSED COUNCIL ABOUT VILLAGE’S RECYCLING ISSUES. SHANNON SAID THEY HAVE MONEY IN THEIR BUDGET TO GIVE US AN EXTRA CONTAINER FOR THE MONTH OF JUNE, JULY, AND AUGUST. SOME OPTIONS SHE GAVE COUNCIL FOR GOING FORWARD WERE (1) INCLUDE IN THE VILLAGE BUDGET THE EXTRA CONTAINER FOR 2023, AND (2) ASK USERS TO BREAKDOWN CARDBOARD OR TAKE CARDBOARD TO KOHART’S SINCE THIS SEEMS TO BE THE MAJORITY OF THE PROBLEM. THESE WERE JUST A COUPLE OF THE OPTIONS SHE MENTIONED. SHE ALSO MENTIONED HAVING A FEW DAYS SET ASIDE TO ALLOW SENIOR CITIZENS TO BRING RECYCLING SO THEY CAN BE ASSISTED WITH PLACING CARDBOARD IN LARGE DUMPSTER. SHE STRESSED THAT IF PEOPLE BROKE DOWN THE CARDBOARD AND ALSO TOOK THEIR STUFF OUT OF THE BAGS (AND TOOK THEIR BAGS BACK WITH THEM TO REUSE) SO THAT IT COULD DISPERSE INSIDE THE TRAILER, IT WOULD ALSO MAKE A DIFFERENCE. WHEN ITEMS ARE LEFT OUTSIDE THE TRAILER, THEY END UP IN THE VILLAGE DUMPSTER AND DON’T GET RECYCLED BECAUSE WMEA CAN’T TAKE THEM.

ZONING INSPECTOR GABE OBERLIN HAS COMPLETED THE ZONING MAP AND ZONING ORDINANCE UPDATES AND ASKED THE VILLAGE TO ACCEPT THE UPDATED DOCUMENTS.

• MOTION MADE BY STEINER, SECONDED BY RISTER, TO APPROVE UPDATED ZONING MAP INCORPORATING ALL AMENDMENTS TO DATE AND ACCEPTING THE UPDATED ZONING MAP AS THE OFFICIAL ZONING MAP OF THE VILLAGE OF ANTWERP AS OF JUNE 15, 2022. 6 YEAS, 0 NAYS. MOTION CARRIED AND APPROVED.
• MOTION MADE BY FRANKS, SECONDED BY RISTER, TO APPROVE UPDATED ZONING ORDINANCE INCORPORATING ALL AMENDMENTS TO DATE AND ACCEPTING THE UPDATED ZONING ORDINANCE AS THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE OF ANTWERP AS OF JUNE 15, 2022. 6 YEAS, 0 NAYS. MOTION CARRIED AND APPROVED.

POLICE CHIEF CLEMENS PROVIDED A WRITTEN REPORT SHOWING 99 CALLS FOR SERVICE FOR THE MONTH OF MAY WITH 6 OFFENSES.

THIRD READING OF RESOLUTION NO. 2022-03: A RESOLUTION TO PROCEED WITH SUBMISSION OF THE QUESTION OF LEVYING A TAX THAT IS A RENEWAL OF AN EXISTING LEVY IN EXCESS OF THE TEN-MILL LIMITATION FOR THE PURPOSE OF PROVIDING AND MAINTAINING FIRE PROTECTION AND EMERGENCY MEDICAL SERVICES (R.C. §§ 5705.03, 5705.19(I), 5705.191, 5705.192, AND 5705.25)

THIRD READING OF ORDINANCE NO. 2022-15: AN ORDINANCE AMENDING ORDINANCE NO. 2010-16, AN ORDINANCE TO RETAIN THE SERVICES OF A ZONING INSPECTOR FOR THE VILLAGE OF ANTWERP, PAULDING COUNTY, OHIO SPECIFICALLY TO AMEND SUCH ORDINANCE TO PROVIDE A ONE-TIME PAYMENT ON COMPLETION OF ZONING ORDINANCE UPDATE.

FOR THE VILLAGE OF ANTWERP, OHIO

EMERGENCY READING OF RESOLUTION NO. 2022-07: A RESOLUTION AUTHORIZING THE VILLAGE FISCAL OFFICER TO ADVANCE $30,796.70 FROM THE GENERAL FUND TO THE OHIO DOD INFRASTRUCTURE GRANT FUND, AND DECLARING THE SAME AN EMERGENCY

ADMINISTRATOR’S REPORT
SHAFFER ROAD – ADMINISTRATOR RECOMMENDED THIS PROJECT BE MOVED TO THE PUBLIC SERVICE COMMITTEE TO DISCUSS OPTIONS. CURRENTLY THERE IS A GRANT UNDER CRITICAL INFRASTRUCTURE IN THE AMOUNT OF $500,000 WITH $500,000 IN A 0% LOAN FOR 30 YEARS. THIS PAYMENT WOULD BE APPROXIMATELY $16,667.00 PER YEAR. THERE ARE OTHER OPTIONS, BUT ADMINISTRATOR SUGGESTED THE COMMITTEE MEET WITH DENNIS MILLER OF MVPO TO DISCUSS FISCAL OPTIONS.

RAILROAD STREET PROJECT – THE VILLAGE WAS AWARDED $48,500 IN CDBG FROM THE PAULDING COUNTY COMMISSIONERS. THESE FUNDS WILL BE AVAILABLE LATE Q1 2023. THE OVERALL PROJECTED COST IS $127,000. THE VILLAGE WILL COVER THE BALANCE OF $78,500. THE ADMINISTRATOR NOTIFIED JEFF COOK OF THE TIME FRAME.

ESRI GIS – VILLAGE HAS SECURED THE LICENSE AND ADMINISTRATOR IS NOW COLLECTING SHAPE FILES FOR MAPPING. ADMINISTRATOR LOOKING AT MVPO TO ASSIST IN LOADING THE FILES. ADMINISTRATOR WILL BE MEETING WITH THEM FRIDAY TO DISCUSS THE PROCESS.

FAMILY DOLLAR TREE – VILLAGE RECEIVED NOTIFICATION THE FAMILY DOLLAR TREE HAS ACQUIRED THE FORMER GROCERY STORE PROPERTY AT 106 EAST RIVER STREET. THEY HAVE ASKED THE VILLAGE MAYOR TO SIGN A LETTER THAT THERE IS NO OBJECTION TO THE BUSINESS BEING LOCATED AT THIS PROPERTY. A LETTER HAS BEEN DRAFTED NOTING NO OBJECTION AS LONG AS ALL LOCAL AND STATE APPROVALS AND PERMITS OBTAINED.

• MOTION MADE BY STEINER, SECONDED BY RISTER, TO APPROVE MAYOR SENDING LETTER TO COMPTON ADDY, THE DEVELOPER OF THIS PROJECT, THAT VILLAGE HAS NO OBJECTIONS TO PROPOSED USE OF REAL ESTATE AT 106 EAST RIVER STREET FOR FAMILY DOLLAR TREE STORE SUBJECT TO ALL APPLICABLE LOCAL AND STATE APPROVALS AND PERMITS. 6 YEAS, 0 NAYS. MOTION CARRIED AND APPROVED.

COMMITTEE REPORTS
UTILITY COMMITTEE MET ON PROPERTY OFF ERIE STREET THAT HAS REQUESTED TO PUT A DRIVE OFF WATERPLANT DRIVE OVER VILLAGE PROPERTY. SOLICITOR FARR SUGGESTED THAT PROPERTY OWNER GET A SURVEY DONE AT THE EXPENSE OF THE PROPERTY OWNER SO AN ENCROACHMENT AGREEMENT CAN BE PUT IN PLACE NOTING THE AREA AT ISSUE. BRYAN SMITH SAID HE HAD A COUPLE OPTIONS HE WOULD LIKE TO SUGGEST TO THE PROPERTY OWNER AS WELL AND THAT HE WOULD BE IN CONTACT WITH PROPERTY OWNER TO DISCUSS SURVEY AND OTHER OPTIONS.

STEVE JORDAN INFORMED COUNCIL THAT THE STATE IS AWARE THEY HAVE CREATED SOME ISSUES WITH NEW REQUIREMENTS FOR VOLUNTEER FIREFIGHTERS WHICH IS CAUSING A SHORTAGE ALL OVER OHIO. HE BELIEVES THAT THE STATE WILL BE ADDRESSING ISSUES.

NEW BUSINESS
COUNCILMAN STEINER ASKED ABOUT ACH DEBIT FOR WATERBILL PAYMENTS. FISCAL OFFICER LICHTY EXPLAINED TO STEINER THAT MOST BANKS HAVE A BILLPAY OPTION THAT THEY CAN SET UP THROUGH THEIR OWN BANKING INSTITUTIONS THAT WILL AUTO PAY THESE BILLS AND MAIL A CHECK TO THE VILLAGE OFFICES TO BE APPLIED. ACH DEBIT AS WELL AS CREDIT/DEBIT CARD PAYMENTS WAS LOOKED INTO BEFORE AND WHEN ASKING THE RESIDENTS IF THEY WOULD PAY THE SERVICE FEES FOR THIS OPTION, THEY DID NOT WANT TO BE RESPONSIBLE FOR IT.

STEINER ALSO ASKED WHY THE VILLAGE WAS NOT ON AMERICAN LEGAL PUBLISHING WEBSITE LIKE OTHER SURROUNDING VILLAGES. HE STATED THE VILLAGE PASSED OHIO BASIC CODE EARLIER THIS YEAR AND WONDERED IF WHEN VILLAGE PAYS FOR OHIO BASIC CODE BOOKS IF THEIR WEBSITE IS PART OF THAT FEE. ADMINISTRATOR DAVIS WILL CONTACT AMERICAN LEGAL PUBLISHING AND SEE WHAT IS INCLUDED.

OLD BUSINESS
SOLICITOR FARR UPDATED COUNCIL ON 102 RIVER STREET. A REVOCABLE USE PERMIT HAS BEEN PROVIDED FOR THE SIGN AND CANOPY THAT ENCROACH IN THE RIGHT-OF-WAY. AS TO WATERLINE EASEMENT, A NEW LEGAL DESCRIPTION MAY BE PROVIDED AND IF IT IS, THEN AN AMENDED DOCUMENT CAN BE PREPARED AND RECORDED TO CORRECT THE EXISTING LEGAL DESCRIPTION FOR THIS EASEMENT.

STEINER AGAIN ASKED COUNCIL TO MOVE FORWARD ON HIS PROPOSED “ANIMAL REGULATIONS PROPOSED FOR MODIFYING RI NEIGHBORHOODS”. SOLICITOR FARR EXPLAINED THAT IF THIS WAS A RECOMMENDATION TO AMEND THE ZONING ORDINANCE TO MODIFY PERMITTED USES IN A ZONING DISTRICT, THEN A MOTION WOULD NEED MADE TO TRANSMIT THIS RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION TO AMEND THE ZONING ORDINANCE.

• MOTION MADE BY STEINER TO TRANSMIT TO THE PLANNING AND ZONING COMMISSION A RECOMMENDATION TO AMEND THE ZONING ORDINANCE TO ALLOW SMALL LIVESTOCK IN R-1 ZONING DISTRICTS. NO SECOND TO THIS MOTION. MOTION DIES.

• MOTION MADE BY RISTER, SECONDED BY REINHART, TO TABLE ALL DISCUSSION OF RAISING LIVESTOCK IN VILLAGE LIMITS UNTIL A MOTION IS PASSED TO TAKE DISCUSSION FROM TABLE. 5 YEAS, 1 NAY. MOTION CARRIED AND APPROVED.

MAYOR’S REPORT
MAYOR’S COURT BROUGHT IN A TOTAL OF $285.00 IN THE MONTH OF MAY 2022 WITH $207.00 GOING TO THE VILLAGE, $75.00 GOING TO THE STATE, AND $3.00 GOING TO THE INDIGENT DRIVER’S FUND.
